In many (probably "most") jurisdictions, yes. Certainly there are
some that are encrypted, and that trend has accelerated at least a little bit over the last few years. But from what I've seen, plenty of LE agencies (in the US anyway) are still in the clear.
Now, as others have noted, a lot of them have now gone to digital trunked systems (P25, and suchlike) that are more difficult to receive/decode. But that's not "encryption", it's just an annoyance.
